Jefferson Memorial Funeral Home is under contract to furnish all or any part of the merchandise and services provided under Brown-Service Insurance Policies. The insurance policies are three related but distinct types. One type is generally known as a “burial” insurance policy under which the benefits are payable solely in funeral services and merchandise incident to burial, and is sometimes referred to as a “merchandise” policy. The second type is generally known as a “funeral” policy or “funeral expense” policy under which the benefits are payable in funeral services and merchandise incident to burial or in cash and is sometimes referred to as a “merchandise or cash” policy. The third type is the “vault” policy which, pursuant to the order of the United States District Court in Birmingham, Alabama in Case No. 70-H-752-S, provides cash benefits in the amount of the stated retail value of the policy.
The insurance policies referred to in the above paragraph include the policies, riders, endorsements and supplements thereto heretofore or hereafter issued or assumed by Liberty National.
Brown-Service furnishes the funeral merchandise to be used under the burial policies of Liberty National.
Jefferson Memorial does not warrant this merchandise in any form or fashion.
